Terms & Conditions of this promotion

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the Terms and Conditions and by participating all claimants will be deemed to have accepted and be bound by the Terms and Conditions. Please print a copy of these Terms and Conditions and retain for future reference.

Promoter: pladis (UK) Limited, Building 3, Chiswick Park, 566 Chiswick High Road, Chiswick, London, W4 5YA (please do not send correspondence to this address). (“Promoter”).

  1. Eligibility: Entry is open to residents of the United Kingdom (England, Scotland, Wales and Northern Ireland) and Republic of Ireland, aged 18 or over. The following are excluded from entry:
    1. Directors, management, and employees of the Promoter or its holding or subsidiary companies.
    2. Employees of agents or suppliers of the Promoter, or any third parties professionally connected with the competition or its administration.
    3. Members of the immediate families or households of (a) and (b) above.
  2. Requirements: Entrants must have internet access, smartphone, email address and mobile number. No purchase necessary.
  3. Main Promotional Period: The Main Promotion opens 00:00 on 03/08/2026 and closes 23:59 on 21/09/2026 (the “Closing Date”).
  4. Wrap Up Period: The Wrap Up Period opens 00:00 on 22/09/2026 and closes 23:59 on 02/11/2026. All valid entries received in the Main Promotional Period and the Wrap Up Period will be entered into a Prize Draw to win any unclaimed or forfeited prizes or 10 x Limited Edition Penguin Random House x McVitie’s Penguin Joke books.
  5. Entry Instructions: The smartphone must be linked to an active account with a recognised mobile network provider. The account holder must be the same person completing the entry. Promotion is limited to one entry per smartphone per day, maximum two entries per week and 1 prize per tier per household.

    To enter:

    1. Scan QR code on promotional packs or in store point of sale communications. Alternatively, visit mcvities.co.uk/promotions.
    2. Enter full name, smartphone number and email address.
    3. Once entry is completed, entrants will instantly receive an onscreen “win” or “lose” message.
    4. Winners only will be texted a unique link to claim their prize. They will be required to enter their details, including their full postal address, to claim their prize.
    5. A maximum of one entry per day and two entries per week per person is allowed. Only one prize is awarded in each prize tier per household. One prize may be won from each prize tier, subject to eligibility.
    6. Entry may only be made online on our web page using the method described in (a), (b) and (c) above. Entries by any other means, for example postal entries, shall not be accepted.
    7. In the event that the site has entries in which a bot is suspected, you may be required to validate either your mobile number or email address in order to validate your entry. This is at the Promoter’s discretion and is in addition to the above requirements.
  6. The Promoter will not accept:
    1. Responsibility for late, incorrect, illegible, incomplete, defaced, corrupt, lost, mislaid, damaged or delayed entries.
    2. Proof of transmission as proof of receipt.
  7. No third party or bulk entries. Automated entries, entries via syndicates, macros or similar will be disqualified. Fraudulent activity or falsifying data will void all associated entries and prizes.

  8. Main Promotion Prizes:

    1. Tier 1: 3,000 x Limited Edition Penguin Random House x McVitie’s Penguin Joke books with a foreword written by a recognised author, awarded via guaranteed instant winning moments.
    2. Tier 2: 20,000 x full title Audiobooks, awarded via guaranteed instant winning moments. There are limited quantities of each title, and they are offered on a first-come, first-served basis. As the Promotion progresses, individual titles may become unavailable and will be removed, so the range of titles available to later winners may reduce. The Promoter does not guarantee the availability of a particular title.

  9. Wrap Up Draw Prizes:
    1. 10 x Limited Edition Penguin Random House x McVitie’s Penguin Joke books with a foreword written by a recognised author, awarded via prize draw.
    2. Any unclaimed or forfeited prizes will be awarded.
  10. Winner Selection:

    Instant win via guaranteed winning moments – Total of 23,000 winners.

    Guaranteed winning moments allocated by secure algorithm, first valid entry after each moment wins. If no entry is received between one winning moment to the next, the Prize from that winning moment will be rolled over, creating an additional winning moment. Winning moments have been randomly pre-allocated and independently verified prior to the start of the Promotion. All 23,000 winning moment Prizes have been made available, and it is intended that they will be won.

    Wrap Up Prize Draw: Any unclaimed or forfeited prizes plus there will be ten (10) winners drawn from all entries received during the Main Promotional and Wrap Up Draw Period and will be selected at random by week commencing 9th November 2026, under the supervision of an independent adjudicator from all valid entries received.

  11. Winner Notification:

    Winners will be notified instantly on screen that they have won. They will then receive a text message to the mobile number they entered on registration with a link to follow to claim their prize. They will be required to submit their full postal address to claim their prize. If a winner does not follow the link and successfully claim their prize within 14 days of the winning text message, their prize will be forfeited.

    Wrap Up Prize Draw: The Winners will be notified via text within 7 days of the prize draw. The text message will be sent to the mobile number they entered on registration with a link to follow to claim their prize. They will be required to submit their full postal address to claim their prize. If a winner does not follow the link and successfully claim their prize within 14 days of the winning text message, their prize will be forfeited. No further reserves will be awarded.

  12. Winner Fulfilment:
    1. Tier 1 Winners: The Promoter and their partners will aim to fulfil the limited-edition Penguin x Penguin Joke book within 28 days of claim.
    2. Tier 2 Winners: Audiobook winners will be sent their Google Play Audiobook redemption code via email, to the email address submitted on registration, within 7 days of claim. The winner will have the option to choose from the list of titles available at the time and date of their claim. All winners must have a Google Play Books account and redeem their Audiobook on Google Play by 3rd February 2027. You can find the Google Play Books user terms of service here.
  13. The Promoter reserves the right to amend or withdraw the Promotion if deemed necessary due to circumstances outside of its reasonable control.
  14. The Promoter’s decision is final on all matters relating to the Promotion.
  15. If the Promoter has reasonable grounds for believing that an entrant has contravened the Terms and Conditions, the Promoter reserves the right to select an alternative winner.
  16. The winners’ surnames and counties can be requested by emailing info@winners-list.com with the subject “8646 Winners List” and will be available for a period of 4 weeks from 13/11/2026.
  17. By entering this Promotion, each entrant acknowledges that if selected a winner, their surname and county may be disclosed to persons enquiring, where permitted by law. Any entrant may object to their information being made available in this way or may request that the amount of information made available be reduced, by contacting the Promoter. In these circumstances the entrant acknowledges that the Promoter may nevertheless disclose such information in full to the Advertising Standards Authority if required to do so.
  18. Entrants must enter the Promotion using their legal name. The Promoter will verify the eligibility of prize winners. The Promoter will require such information that it considers reasonably necessary for this purpose, and a Prize may be withheld unless and until the Promoter is satisfied with the verification.
  19. The Promoter seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entries (and any of your associated aliases) will be disqualified, any prize awarded may be void and recoverable, and the Promoter reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Promoter reserves the right at any point to:
    1. Verify the eligibility of entrants by requesting such information it considers reasonably necessary for this purpose. Entry or a prize may be withheld unless and until verification is completed satisfactorily.
    2. Disqualify entries that are not made directly by the individual entering the Promotion.
    3. Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.
    4. Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.
    5. Disqualify entries beyond the maximum allowed, or those using techniques such as “script”, “brute force”, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.
    6. Disqualify entries which, in some other way, do not fully meet the requirements of these Terms & Conditions.
  20. Where a winner has been found to be in breach of any of these Terms and Conditions and in particular where a person is in breach of the entry restrictions, the Promoter may nevertheless still enforce its right to disqualify that person and require the return or reimbursement to the Promoter of any Prize even where a prize has been awarded and/or actually provided to the entrant or winner in question.
  21. The Promoter makes no representation or warranty in relation to any Prize provided. Except as specifically set out herein and to the maximum extent permitted by law, all conditions, warranties and representations expressed or implied by law are hereby excluded. To the fullest extent permitted by law, the Promoter hereby excludes and shall not have any liability to any entrant or winner in connection with or arising out of this Promotion howsoever caused, including for any costs, expenses, forfeited prizes, damages and other liabilities, provided that nothing herein shall operate so as to limit or exclude our liability for personal injury or death caused by our negligence or liability for fraudulent misrepresentation. For the avoidance of doubt, this paragraph shall also apply in respect of any prize provided by a third-party provider.
  22. If for any reason the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, subject to any written directions given under applicable law, to disqualify any individual who tampers with the entry process and to terminate, modify or suspend the Promotion.
  23. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation.
  24. Winners may be invited to participate in reasonable publicity arising from the Promotion with no further compensation.
  25. This Promotion is governed by English Law, and entrants submit to the exclusive jurisdiction of the English courts, save that nothing in these Terms and Conditions shall deprive residents of the Republic of Ireland of any mandatory protections afforded under Irish law.
